A West Virginia man has been killed by a dump truck. The Fairview man was on private property when the dump truck accident occurred. Another Fairview man was driving a Mack dump truck that was apparently owned by Yost and Yost Pipe Company.
The victim was on foot when the accident occurred. Sadly, he was pronounced dead at the scene. The Monongalia County Sheriff's Department is still investigating the accident. It is not yet known whether any charges will be filed in connection with the incident.
The family of the victim is likely awaiting the results of the investigation while also struggling to come to terms with the sudden death. The shock of losing a loved one can often carry a family through the final preparations they are forced to make for their family member. Unlike cases where death is anticipated, when a loved one is taken from a family in an accident, it can leave them dazed and confused and searching for answers.
Ultimately, they may wish to assess their right to file a wrongful death action against the driver of the dump truck in connection with this truck accident, as well as against the dump truck owner. Filing a wrongful death action can seem complicated and time consuming. Being able to prove in court that the negligence of another party caused the death of their family member may not be as easy as it sounds. It will be the responsibility of the family to provide sufficient proof of negligence in order to prevail in court. If they are successful, however, they may be awarded monetary compensation for those expenses they have incurred as a result of the accident along with any other damages permissible under West Virginia laws.
