The West Virginia State Police has released the names of two women that were killed in Lewisburg. The women were victims of a one car accident. Three other occupants in the vehicle, including a 2-year-old boy, were also injured.
For an as yet undetermined reason, the driver of the vehicle lost control and slammed into a tree. The vehicle then caught fire. One of the deceased women was pronounced dead at the scene. The other deceased woman was taken to an area hospital. Despite the efforts of medical personnel at the hospital, the woman succumbed to her injuries and died.
The toddler, the driver of the vehicle and another occupant were all taken by helicopter to the hospital with unspecified injured. At that time, it was reported that they were all in stable condition. No information on their current condition is known. The West Virginia State Police are still investigating the accident in an attempt to determine what happened; however, police believe that the driver was traveling at a high rate of speed at the time of the accident.
Whether any charges will be filed against the driver remains to be seen. In the meantime, the families of the deceased victims and those occupants that were injured have the right to file civil action against the driver. The court may award each of them monetary compensation for the costs and damages incurred as the result of this horrific car accident. In order to prevail in either a wrongful death action or a personal injury claim, it must be shown that the driver was negligent and that the driver's actions caused or contributed to the death or injury of each party.
