2 injured, 1 dead in logging truck accident in West Virginia

The West Virginia Division of Highways had to shut down the northbound lanes of Route 199 recently due to an accident. Two people were injured and one was killed in the logging truck accident. Even though this does not seem to be a section of road that has a lot of accidents, the possibility that concrete barriers separating the north and south lanes may have prevented this crash.

A logging truck was heading south when he lost control for some as yet unknown reason. The truck rolled over into the oncoming lanes of traffic and slammed into another vehicle. The truck's load was scattered all over the highway and had to be removed.

The driver of the truck and the driver of the vehicle the truck hit were both taken to an area hospital to be treated for injuries that were not disclosed. There was a passenger in the vehicle the truck hit that did not survive the crash. That person was pronounced dead at the scene.

As the scene was being cleaned up, Kanawha County deputies attempted to recreate the logging truck accident to discover its cause. Under West Virginia law, the injured driver and the family of the deceased passenger each have the right to file a civil claim against the party or parties deemed responsible for the injury or death, as applicable. If it can be documented that the driver of the truck was negligent and that negligence caused or contributed to the injuries sustained by the driver and the death of the passenger, they may be awarded costs and damages such as medical bills, funeral costs and lost wages.
