Man facing drunk driving charges after a fatal car accident

A West Virginia man has been given a trial date in a case that involves a fatal car accident related to drunk driving. The defendant is accused of killing a police officer in the course of a drunk driving car accident. He is currently facing between 25 to 50 years incarceration for the incident.

Officially, the man is facing charges of driving while under the influence, leaving the scene of the accident and causing a police chase. During the police chase, the man accidentally hit a police car. The impact resulted in the death of a West Virginia police officer. The man previously went on trial in Greene County and was convicted of murder in the third degree, as well as other various charges.

New charges have been filed in Monongalia County for other crimes that occurred before the fatal accident. Because the charges are from two separate counties, the man will face two different trials, even though he is already facing the consequences of the first conviction. It is not clear what charges he is facing in the second legal trial.

Aside from what the man is already up against, the family of the deceased could consider a wrongful death suit for the unexpected loss of their family member. While the driver could be held responsible for the death, it is also possible that the state could be liable for hazardous and dangerous work conditions. It is not evident if the family has yet filed a suit over the car accident, but they do have the right to seek compensation. A thorough examination can reveal all possible legal options.
