Arctic Cat ATVs may stall -- defect could lead to serious crash

All-terrain vehicles are very popular. This is especially true during the summer months in West Virginia. However, even as the weather cools off many enthusiasts still rely upon ATVs to provide enjoyment, even with the ever present safety risks. This is even more true when the ATV is actually defective, which could result in a serious crash.

A component on some 2008 and 2009 model Arctic Cat ATVs may result in the driver losing control of the vehicle. For that reason, Arctic Cat recalled these vehicles. At this time, the company has recalled approximately 40,000 ATVs that it began selling to consumers in May 2007.

So far, Arctic Cat has apparently been informed of nearly 45 incident reports. All of these reports involved the malfunction of a piece in the front gear case. Roughly 10 of those reports resulted in the ATV stopping suddenly or the driver lost control of the vehicle. There have been four separate reports of injuries. One person suffered knee and back injuries as well as broken ribs.

West Virginia ATV operators can help prevent accidents from occurring by ensuring they are familiar with how to safely operate the vehicle. However, not all of these accidents are caused by user error or unsafe operation. When there is a defective component on a vehicle or an ATV, it can result in a serious crash leading to injuries and possibly even fatalities. Nevertheless, our laws provide for the right of victims (including the surviving family of fatal victims) to take action against the manufacturer or others in the consumer supply chain in order to pursue a liability claim for the defective product that caused the injuries or a loved one's death.
