Car crash can take place because of texting and driving

A car accident in West Virginia can take the life of a person or cause severe injuries to someone in a split second, and can happen for a number of reasons. One of the more common car crash causes is distracted driving, which is cited anytime that a driver is distracted by doing something other than focusing on the task at hand. Texting while driving is one problematic example of distracted driving.

In a recent survey, 98 percent of people said they realized that texting while driving was dangerous. Even so, about 75 percent of them said they had sent text messages while driving. In addition, over 25 percent said they felt comfortable with multi-tasking while driving.

The nationwide survey included over 1,000 people between the ages of 16 and 65 who drive nearly each day and send a text once a day or more. More than 40 percent of texting drivers surveyed said they texted while driving simply because they wanted to remain connected with family, friends and work. About one-third of these respondents said they did so out of mere habit. In fact, people admitted they texted and drove despite the fact that many public service announcements have been made about the dangers of doing so.

If someone becomes injured because another person texted while behind the wheel, the negligent driver may be held financially responsible for the other person's injuries. It is within the rights of the victim to file a personal injury claim with a West Virginia civil court, pursuing monetary damages that can cover his or her hospital bills and even compensate for income lost from not being able to work following the car crash. For a personal injury claim for injuries sustained in a car crash to be successful, it must be proven that the subject of the claim was indeed acting in a negligent manner.
