Defective product may cause problems for nut allergy sufferers

Nut allergies can be extremely dangerous. It is crucial that individuals in West Virginia who have nut allergies be very careful when selecting products. Unfortunately, in some cases, a defective product containing nuts does not disclose the allergens on the ingredient statement on the product packaging.

The manufacturer of Ortega taco products has recently issued a voluntary recall of some of their products. The reason behind the recall is because of the possibility that some of its products may contain almonds and peanuts. Neither of these allergens are listed on the ingredient list on the taco products. Ortega is blaming the oversight on spices obtained from a supplier. The manufacturer has stated that it will be ending its relationship with the allegedly negligent supplier.

The company has made sure that consumers understand that no individuals are at risk unless they have an allergy to almonds, peanuts or both. Individuals who do not have an allergy to these items are not at risk of adverse effects. However, those with an allergy could suffer from hives, rashes, swelling or difficulty breathing. In severe cases, a consumer with a nut allergy who is unable to get treatment in time could die.

Although it is true that mistakes can happen when labeling products, consumers in West Virginia expect for manufacturers to be diligent in ensuring that major mistakes do not occur that will impact product safety. While a mislabeled product may be harmless to some, it could be deadly for others. For individuals who suffer a serious allergic reaction due to a mislabeled or defective product, it may be possible to obtain a financial settlement from the manufacturer via a product liability claim.
