Car accident results in 1 death, 3 injuries

One young woman died and three other individuals were injured in a recent West Virginia crash involving two vehicles. The car accident took place on a Monday night in late December. According to reports, the collision occurred about an hour northwest of Charleston.

Police said a 25-year-old woman pulled out in front of a vehicle that was reportedly traveling in her direction on a two-lane road. The young woman died at the accident scene. Meanwhile, two of her passengers suffered injuries and were taken to the hospital.

The person driving the second car also was injured and transported to a nearby hospital. The injured parties have since been released from the hospital. Officials said they were reconstructing the accident to determine fault and in an effort to make the street safer for future travelers.

Those injured in the car accident may decide to file personal injury claims, so, if a police investigation reveals that the driver who died was the one who caused the accident due to negligent behavior, those injured in the accident will have to seek damages from her estate. Competent proof of negligence is required to establish a driver's liability in a West Virginia civil court. Only when liability has been established will a judge rule in favor of a plaintiff. Monetary damages awarded from successfully navigated claims may assist victims financially as they recover from injuries they sustained in an accident. A monetary award may also provide compensation for emotional distress or pain and suffering caused by the accident.
