Man dies in West Virginia motorcycle accident

Motorcyclists are particularly in danger of suffering major injuries and even dying in a vehicle collision simply because they lack the protection that occupants of enclosed vehicles typically enjoy. Sadly, a West Virginia man recently died in a motorcycle accident. Police said the accident was the result of another party's decision to drive under the influence.

This accident happened at around 9:30 p.m. on a Sunday. It occurred along Route 2. Police said a 46-year-old man was trying to pull out of the driveway at his home. Unfortunately, he struck a 25-year-old male motorcyclist.

The motorcyclist ended up dying at the crash scene. Police reported that the driver of the car told them he had just taken Xanax before entering the car and did not see the motorcycle. The car driver was charged with DUI-Death.

In addition to facing legal trouble in the criminal justice system, the car driver may also face legal challenges in the form of a wrongful death civil lawsuit. The surviving family members of the man who died in the motorcycle accident have the right to file a claim against the car driver and owner, seeking monetary damages. If the accused man is convicted of the DUI charges in criminal court, proof of the conviction may be presented in a West Virginia civil court to try to establish his financial liability in the motorcyclist's death. A claim that is properly litigated may result in damages that might help to cover the deceased man's funeral costs and other monetary losses tied to the tragic incident.
