2 die in car accident allegedly caused by DUI

One recent car crash led to the deaths of two individuals recently in West Virginia. Police said drunk driving was a causal factor in the collision. The car accident took place on a Saturday at about 3 a.m.

According to officials, the crash involved two vehicles. When police arrived at the scene with firefighters, they saw two cars and one was on fire. Investigators were then told that three individuals had left the accident scene. Meanwhile, two people who were left behind died in the wreck.

A woman was later found and arrested at a 7-Eleven store in connection with the crash. The arrest was made multiple miles from the accident scene. The woman now faces charges of failing to maintain control of her vehicle, not rendering aid, obstructing a police officer and DUI leading to death.

The woman arrested on DUI charges not only faces challenges in criminal court but also may face legal challenges in civil court. This is because the loved ones of the two people who lost their lives in the alleged car accident may choose to file wrongful death claims against the woman who was arrested for DUI. Under West Virginia law, they have the right to seek the reimbursement of monetary damages resulting from these types of crashes, such as burial costs and other losses stemming from the accident. If the woman ends up being convicted of her DUI charges, proof of the conviction may be presented in civil court in order to help establish liability to the court's satisfaction.
