1 dies, 2 injured in car accident in West Virginia

One person has passed away in West Virginia as a result of a vehicle collision. The car accident took place on a Tuesday night near the University of Charleston. It happened at around 9:15 p.m.

According to police, a white vehicle went over the median and entered the westbound lanes from the eastbound lanes. All of a sudden, this car crashed into a red sport utility vehicle. The collision was a head-on crash.

The car driver, 24, died at the accident scene. Meanwhile, a passenger in the vehicle was trapped inside it and, after being freed, was taken to the hospital. Only one woman was in the SUV at the time of the collision; she was also transported to a medical center with injuries deemed not to be life-threatening. Police said it was unclear what led the car to enter the opposite lanes.

If the evidence suggests that the car driver caused the car accident due to negligent driving, such as speeding or distracted driving, personal injury claims may be filed by the injured car passenger as well as by the woman from the SUV who was injured. Although the car driver passed away in the collision, this driver's estate may still face litigation, and anyone else who separately owned the car may also be named in a civil suit. The plaintiffs may pursue monetary damages, which -- if achieved -- may help them to cover their medical costs and other accident-related expenses. Liability must be established to the satisfaction of the civil court before claims for damages will be decided in West Virginia.
