Car accident results in man's death in West Virginia

A 31-year-old man recently lost his life in a West Virginia motor vehicle crash. The car accident took place on a recent Thursday morning. It occurred along Interstate 64.

The car wreck occurred at about 3:30 a.m. It happened along Route 817 a little before the Interstate 64 bridge. The car was occupied by two people.

The passenger in the car passed away. Meanwhile, the driver survived and was able to get out of the vehicle by himself, though he was transported to the hospital. Police said they suspected that alcohol was a causal factor in the collision.

The surviving loved ones of the man who died in the West Virginia car accident may choose to file a wrongful death claim against the driver, seeking reimbursement of monetary damages. Any separate owner of the vehicle he was driving may also be named as a defendant. If it is determined that the motorist was driving under the influence and he ends up being charged accordingly and then convicted in criminal court, proof of the conviction may be presented in a related civil court proceeding in an effort to establish liability. Once liability has been established by appropriate evidence submitted to the civil court hearing the case, claims for financial damages be adjudicated. A monetary judgment cannot restore the life of a loved one who has died in an accident caused by another person's negligence, but it may help surviving family members to achieve at least some sense of justice and help them move forward from the tragedy.
