Lawsuit against nursing home alleges physical abuse

The family members of nursing home residents in West Virginia naturally expect that their loved ones will be properly cared for while in the hands of nursing home staff. However, physical abuse and neglect sometimes occur, leading to serious injuries and even the deaths of their loved ones. In another state, the family members of an 86-year-old man who died in a nursing home recently filed a lawsuit against the home, alleging dependent adult abuse and wrongful death.

According to the lawsuit, the resident passed away due to blunt force trauma to his head. The injury was reportedly sustained after the man fell down concrete stairs at the facility. The family claimed that the man was trying to leave the nursing home through a stairwell door on the second floor, which activated the alarm. However, they asserted that someone reset the alarm without viewing the alarm panel to see which door had been opened.

The nursing home is also accused of being negligent in the care they provided to the man. The family alleged that the nursing home did not transfer the man to a greater care level when this was required in light of his symptoms. The facility is also said to not have had enough to staff to care for the man.

The deceased man's family further claimed that the nursing facility violated the man's dignity, did not follow his care plan, and did not respect or protect his rights. They asserted that the nursing home should have communicated with them about essential and urgent medical matters involving the man. They are seeking unspecified damages as part of the suit. Any person in West Virginia who loses a loved one due to nursing home physical abuse or neglect has the right to file a wrongful death claim in an effort to hold the facility accountable through the civil court system.
