Faulty medical device may lead to serious injury or death

In West Virginia and elsewhere, medical devices are designed to improve a patient's medical condition. However, a faulty medical device can do the opposite, causing severe injuries or even death. In this case, the maker of the medical device may be held responsible.

Often, medical devices and other products are sent through the production process at high rates of speed so that the manufacturer can begin earning profits. Any type of product defect is serious, but defects are especially serious when they involve medical devices, as these devices control the well-being and health of millions of people. It is critical that the devices are safe to use and that both doctor and patients are properly warned about the risks associated with them.

Products that may feature defects include prosthetic devices and stents. Problems with surgical screws and pins, pacemakers and defibrillators can also cause serious injury or death. Joint replacements are also known to have defects.

A person in West Virginia who has suffered harm due to a defective medical device -- such as a heart device, implant or respiration system -- can consult an attorney to explore the options for righting any wrong that has been done. This may include filing a products liability claim against the maker of a faulty medical device. A wrongful death claim may also be filed by the family members who have lost a loved one due to the use of the problem device. Once liability has been established according to applicable law, the court will entertain  demands for specific items of financial damage.
