Alleged surgical errors spark lawsuit following procedure

A man in another state recently claimed that he was injured in a medical procedure. He has therefore decided to file a medical malpractice lawsuit against the medical center where the surgery took place. If a patient in West Virginia or elsewhere suffers injuries due to surgical errors, it is within his or her rights to try to hold the reportedly responsible medical facility and staff accountable.

According to the man's lawsuit, he went to the medical center to be treated for his scapholunate advanced collapse, or degenerative arthritis in the wrist. Doctors performed a procedure on him. However, one doctor allegedly damaged one of his tendons during the procedure.

The man asserted that his condition worsened a couple of months later. He claimed that the doctors were negligent in treating him in that they did not take proper care of him. He is seeking unspecified damages in his lawsuit, asserting that he has suffered other conditions and losses due to the alleged malpractice.

In a case where surgical errors or other medical mistakes causes a person to suffer harm in the state of West Virginia, this person may choose to file a malpractice claim, seeking damages. In addition to being awarded compensatory damages, the victim may be awarded punitive damages in cases of egregious fault. A damage award may help with covering medical bills, the loss of wages and other losses stemming from a documented medical malpractice incident. Understanding what facts need to be proved is important for prevailing in this type of civil court case.
