When Is the Right Time To File a Logging Truck Accident Claim?

In West Virginia, you have two years from the accident date to file a personal injury lawsuit, including logging truck accident claims. However, the sooner you file, the better. Evidence can be destroyed and memories fade. Filing your claim as early as possible will give you a better chance of recovering the maximum compensation.

After a logging truck accident, make sure to do the following:

  • Get medical treatment. The most important step is to seek medical treatment. You may need to call 911 and go to the hospital. Some injuries do not immediately appear, so seek treatment even if you do not feel pain.
  • Report the incident. Call the police to have them document the scene and file an official report. In West Virginia, you are required by law to report any accident that results in bodily injury, death, or property damage to more than $1,000. The police will investigate, document the accident scene, and file an official report.
  • Document the accident scene, if possible.  Exchange contact and insurance information of the other parties involved. Get information from witnesses. Take photographs and videos of the scene. Note any damage, debris, road conditions, traffic signs, etc.
  • Notify your insurance company and the Department of Motor Vehicles. You should call your insurance company to report the accident. You must also report accidents resulting in injury, death, or property damage of more than $500 to the Department of Motor Vehicles.
  • Do NOT make any recorded statements. The other driver’s insurer may ask you to give a statement, but do not speak to them. Anything you say to them may be used to deny or minimize your claim.
  • Hire a West Virginia logging accident lawyer. Call Warner Law Offices to schedule an appointment. We will discuss the details of your case and how we can help you negotiate with the insurance company.

What if My Logging Accident Is Caused by Deliberate Intent?

Most logging truck accidents are just that—accidents. Occasionally, however, accidents are caused by what is known in West Virginia law as “deliberate intent, ” which covers certain workplace injury claims.

In these types of workplace injury cases, an employer acts with deliberate intent to harm employees. For instance, an employer may have known that safety conditions in a work zone weren’t up to standard but still intentionally exposed their employees to them.

Take the following example. In a logging truck accident, an employer may have known there was an operational defect with one of the company’s logging trucks. Knowing this, the employer still chose to allow employees to use and operate near the truck and failed to provide information about the hazards that employees would be exposed to. In this case, any employees injured by the logging truck incident — or their family, in the tragic case of their death — could bypass workers’ compensation and sue the employer directly.

Common Causes of Dangerous Log Truck Accidents

Some common reasons for dangerous log truck accidents include the following:

Logging trucks are massive vehicles, and they carry heavy cargo that can slide off if it is not properly secured. Both the truck driver and all drivers sharing the road with logging vehicles must be mindful of the potential hazards in order to drive safely. Employers also have a responsibility to ensure that the trucks their employees use are properly maintained and not defective.
