Car accident injures an 8-year-old West Virginia girl

When parents put their children on the school bus, they have every confidence that their child will return home safe and sound. Unfortunately, while that is true in most circumstances, accidents can happen. A West Virginia girl was injured in a car accident recently as she was getting off of the school bus.

Witnesses say that the bus had its lights and signals on when an 8-year-old girl was struck by a passing car. The elderly couple either ignored or for some reason didn't see the lights and signals on the bus. The girl was taken to Summersville Regional Medical, but arrangements were being made to transfer her to CAMC General in Charleston. The girl was complaining of leg and ankle pain at the scene, though she was reported to be in stable condition.

The Summersville Police Department is investigating the accident. There has been no indication at this time as to whether the driver will be charged or cited in connection with the accident. Depending on the girl's injuries, the driver of the vehicle that struck the girl may have to defend a personal injury lawsuit.

Even though her family is likely focused on the girl's recovery at the moment, they retain the right to file a personal injury lawsuit on her behalf against the driver in connection with this car accident. Medical bills, ambulance transport, hospital transfers and other costs may be recoverable in a personal injury lawsuit if negligence is established. In addition, a court may award other damages allowed under West Virginia law. For instance, the court may award the girl monetary damages for the pain and suffering she has endured and may continue to endure as a result of the injuries she sustained.
