Police: Speed likely a factor in deadly West Virginia car accident

Recently, the West Virginia State Police were called to the scene of an accident close to Blue Horizon Drive and Route 19 in Monongalia County. One person died in the car accident and another was taken to the hospital. Police believe that speed was a factor in the wreck.

Officials say a GEO Prism driven by a woman from Cassville was hit on the driver's side by a Ford Fusion that was headed northbound on Route 19. The crash was hard enough to cause fatal injuries, and the woman was pronounced dead at the scene. The northbound driver was taken to Ruby Memorial Hospital. At the time this is written there's no word on his condition.

West Virginia State Police are investigating the accident. No charges or citations have as yet been issued. If the evidence supports a finding that the driver of the oncoming car was negligent in a manner that caused or contributed to the crash, he may find himself having to answer a wrongful death claim.

The family of the deceased woman has the right to file a wrongful death claim against the northbound driver as a result of this fatal car accident. Any expenses such as funeral costs may be recoverable in a civil action if it is proved that the fatality was due to the negligence of the other driver.

Filing a wrongful death claim can't bring back their loved one, but a successful result may provide them the monetary compensation to recover financially from consequences of the accident.
