Weather may have contributed to West Virginia car accident

When the weather in West Virginia gets bad, drivers have a duty to take extra precautions and to adjust their driving to compensate for poor road conditions. Unfortunately, some drivers fail to do so and increase their chances of having a car accident. When accidents do happen, any official investigation typically focuses on who did what and when, and whether any traffic or criminal laws were broken.

It is unclear whether the drivers in two accidents that led to one person being critically injured on I-64 in West Virginia had adjusted their driving for the weather. According to the office of the sheriff in Greenbrier County, one vehicle encountered some ice which caused it to slide. The vehicle ended up in the median and burst into flames. Good Samaritans were able to get the driver out of the vehicle and extinguished the fire. Luckily, the driver was not injured.

Before all of the people could leave the median and return to their vehicles, a second vehicle struck a guard rail. The impact caused the vehicle to flip over, landing on a Good Samaritan. The bystander suffered critical injuries and was transported to a medical center in Charleston. The current condition of the bystander is unknown, but it is known that the person was transferred in order to receive additional treatment.

The seriously injured bystander retains the right to file a personal injury claim against the driver of the vehicle that caused or contributed to the injuries sustained. The expenses associated with being involved in a car accident have a tendency to add up quickly, causing a financial burden. Costs such as medical bills and lost wages and other damages are recoverable in a personal injury claim if the injured party is able to show that the injuries were caused by the negligence of another party.
