West Virginia ambulance overturns in auto accident

When people in West Virginia think of ambulances at accident scenes, they don’t often consider that the ambulance was part of the accident. Emergency personnel are typically the ones who come to the rescue of everyone else. However, there are occasions when they find themselves needing help because they have been involved in an auto accident.

This was the case when an ambulance rolled over near Madison. Two paramedics and a patient were in the ambulance at the time of the accident. All three were injured, but the extent and nature of their injuries was not readily known. What is known is that all three were taken to an area hospital for treatment.

The West Virginia State Police are investigating the accident and closed down U.S. 119 for almost an hour in an attempt to determine what happened. The ambulance was the only vehicle involved, and authorities have not yet indicated what caused it to flip. It is not yet known whether any criminal charges or citations will be filed.

The two paramedics may be able to make a claim to workers’ compensation for their injuries. The patient, however, retains the right to file a personal injury claim against the ambulance driver and that driver’s employer in connection with the auto accident. If the evidence indicates that the driver was negligent, the patient is entitled to recover the expenses incurred as a result of the injuries sustained in the accident. Expenses such as medical bills and lost wages are recoverable in a personal injury claim, along with any additional damages allowed under our state laws that the court decides are appropriate.
