Driver that caused car accident may have been drunk

It could be and has been said that drivers that get behind the wheel of a car after they have been drinking are putting the lives of everyone they encounter on the road in danger. The diminished capacity of a drunk driver greatly increases the possibility of a car accident. A recent car accident in West Virginia is a prime example.

A woman traveling on Interstate 64 near Huntington was hit head on by another car on the Fifth Street Hill. When emergency personnel arrived at the scene, they found two vehicles occupied only by their drivers. Both drivers had to be freed from their vehicles and transported to a local hospital.

Even though medical personnel did what they could to save the woman's life, it was too late. Her injuries were too severe and she died at the hospital. Meanwhile, police found evidence indicating that the driver of the vehicle that hit her had been drinking. As a matter of fact, it turns out that the driver had numerous DUI convictions, and his license had been revoked at the time of the accident due to a DUI.

So far, West Virginia authorities have obtained an arrest warrant for the driver, charging him with DUI causing death. There is a possibility he will face additional charges as well. Unfortunately, the criminal charges facing the driver will not restore this woman to her family; nothing can do that now. The only legal action the family can take against the driver is to file a wrongful death claim against him to seek recovery of the financial losses sustained as a result of the car accident.
