Toddler with serious brain injuries receives settlement

When a person suffers a serious injury for any reason, like trauma to the brain, it can be a difficult and even tragic experience for that person and his or her family and loved ones. Although many times accidents happen, there are cases when these terrible situations can be avoided. If a person has suffered a brain injury in West Virginia because of the negligence or carelessness of an individual or business, that person or his or her loved ones may be entitled to compensation for the pain and suffering caused by someone else's wrongdoing.

A three-year-old toddler who suffered permanent brain injuries will now be able to receive the life-long care he will need after a hotel owner recently agreed to a $10.9 million settlement. A little more than $5 million will be placed in a trust for the boy, while legal and medical fees will consume the rest of the settlement amount. The accident occurred while the boy was walking on the second floor of the hotel. Apparently, the railway had an opening in it, which the boy fell through.

It is certainly a tragedy that this child has suffered these permanent brain injuries and that he will be affected for the rest of his life. However, thanks to receiving this settlement his family can now make sure that he receives the long-term care he needs without having to constantly worry about whether or not they will be able to cover his medical expenses. These types of accidents are exactly why any person that is a victim of brain trauma or brain damage caused by someone else's negligence should be aware of their legal rights. It is a person's right to pursue accident compensation in any preventable accident.
