Car accident involving bus leads to injury in West Virginia

| Feb 21, 2014 | Car Accidents

While driving, an individual may primarily be focused on finishing up an important work project or even thinking about the kids’ activity schedules. However, having a sudden vehicular collision with a large bus and suffering serious injury in the process can quickly turn a normal day into an emotionally and physically traumatic one. Buses overall are fairly safe modes of transportation, unless the person who is operating a bus fails to exercise care behind the wheel, in which case a car accident can ensue.

A woman recently filed a suit against a West Virginia transit authority, transportation authority and department of transportation. The bus was supposed to yield the right of way to the woman. However, instead it ended up hitting her car, according to the woman.

The woman suffered injuries as a result of the crash. She claims that the bus driver was behaving negligently behind the wheel. As a result, she is seeking financial damages.

The injured party certainly has the right to file a personal injury claim against the bus driver and the driver’s employer. This allows her to hold these parties financially responsible for the car accident and to request reimbursement of monetary damages that can help with medical costs and other losses linked to the incident, such as the loss of wages. Evidence of the bus driver’s failure to yield the right of way to the car may be offered to try to establish the driver’s liability in a West Virginia civil court. Only if liability is established to the court’s satisfaction will claims for damages be determined in favor of the victim.
