Car crash can happen due to distracted driving

A serious accident in West Virginia can leave a person with critical injuries or even end up in death. In many accident cases, distracted driving is the culprit in a car crash. In fact, cell phone use and texting have become some of the leading causes of wrecks in the state.

You may not have noticed whether a person who injured you in a collision was using a cell phone at the time of the crash. However, your attorney can get mobile phone records to determine whether the other party was talking, browsing the Web or texting right before your accident. In West Virginia, it is illegal to use cell phones behind the wheel.

It is also illegal to text while driving in our state. Furthermore, novice drivers cannot even use any hands-free device. A distracted driver may incur points on their driving records and face fines in West Virginia.

If you are injured in an accident caused by another party's distracted driving, you have the right to seek to hold this person accountable via the legal system. You may seek fair and full compensation for pain and suffering, lost wages, medical expenses and other monetary losses sustained in the car crash. There must be sufficient proof that the other driver was negligent before a judge will find this other person to be financially responsible for the injury crash. Awarded damages may make it easier for you to move on from a life-altering accident and experience some sense of justice and closure.
