West Virginia car crash leads to 1 death, 1 injury

One woman was recently injured and a man passed away in a West Virginia car crash. Police say that the car crash happened on Route 34. The condition of the injured woman was not immediately known following the wreck, authorities reported.

Police reported that one vehicle was going south on the roadway and was trying to turn left into a gas station. At that time, a vehicle that was heading north couldn't stop. The northbound vehicle, driven by a 26-year-old man, ended up striking the other automobile head-on.

A third automobile was headed north as well and couldn't come to a stop. This vehicle hit the first northbound vehicle, police said. The 26-year-old man was killed. It was not immediately clear which vehicle the injured woman occupied. Police continued to investigate the collision.

A full police investigation may reveal who was at fault with regard to the car crash. If the driver of the southbound vehicle is found to have caused the man's death due to negligent behavior -- for example, failure to yield to oncoming traffic -- then he or she may face a wrongful death claim. The plaintiff in such a case must furnish competent proof of negligence in civil court in order for the other driver's liability to be established. Only then will a judge decide claims for financial damages in favor of the plaintiff. Damages awarded in such a case in West Virginia can help to cover the deceased man's burial costs as well as help to address the surviving family's pain and suffering resulting from the wreck.
