Woman Claims Defective Product Caused Serious Injuries

There are numerous products in West Virginia that are designed to help a person clean. Strangely enough, many of the products meant to help keep a house clean enough to live in could cause serious damage. In fact, one out-of-state woman alleges that a company’s defective product ultimately caused her to suffer serious injuries.

The woman purchased the cleaning product, Totally Awesome All Purpose Concentrated Cleaner, from The Dollar Tree. However, she and her husband claim that negligence on the part of both the store and the company that made the cleaner, Awesome Products, Inc, led to an accident that caused serious injuries. Court papers indicate that the spray nozzle unexpectedly separated from the bottle, causing injuries to her eyes, neck and back.

The lawsuit alleges that the store and manufacturer failed to test the product’s packaging before making it available to customers. Additionally, the plaintiffs claim that The Dollar Tree did not provide sufficient training to its employees, describing how to recognize hazardous conditions. The woman is allegedly suffering from financial complications as a result of the accident, including medical bills and lost wages due to her diminished earning capacity.

When a person purchases a product such as a cleaner, he or she expects that the product and packaging is safe. A person who has been injured as a result of a defective product has the option of seeking legal recourse in a West Virginia civil court. By pursuing such action, a person injured as a result of such a product could receive an award to help with the financial implications and could help motivate the company to make the product safer for future customers.
