Tankless Water Heater Recalled as Defective Product

Consumers are aware of the fact that the justice system is there in the event that they become victims of a burglaries or other crimes. However, many are not familiar with the fact that there are laws in place to help protect consumers from manufacturer negligence when it comes to defective products. One such defective product that has been recalled recently is a tankless water heater that may be in many homes, including homes in West Virginia.

The brands of the recalled water heaters are Quietside and Coaire. The brand names can be found on the fronts of the heaters. The recall is for both single- and dual-purpose models that transmit either 4 or 7.2 gallons of water each minute. The water heaters were first sold in July 2008 and were sold online and at brick-and-mortar stores through Aug. 2014.

The reason for the recall is that the water heaters are believed to be potential fire hazards, due to overheating. So far, the manufacturer has received 40 incident reports. In all cases there were reports of property damage, ranging in severity. No consumer injuries have been reported.

A products liability claim does not have to include injury to the consumer. A claim can be brought against a manufacturer even when there has only been property damage, as in the cases involving the defective water heater. This is because a claim can be filed anytime there is significant damage that would never have occurred had the manufacturer exercised more care in either design or production. If claims are successful, West Virginia residents may be able to recoup expenses resulting from damage caused by defective products.
