Defective medical devices: HeartWare issues recall

Advances made in medical technology have allowed people in West Virginia and across the country to live longer, more productive lives. Unfortunately, defective medical devices can often cause more harm than good, resulting in serious injury or even death. One company has recently issued a recall of one of its products after one person was killed and another injured.

The product in question is the HeartWare Ventricular Assist System Controller. Reports indicate that the product was distributed during a trial period before being approved by the Federal Drug Administration. The recall could impact approximately 120 patients in the United States.

A letter sent by HeartWare says that patients with this device could be at risk for an electrostatic discharge event. Such an event could cause death or serious injury. For patients impacted by the recall, a clinician must assess the potential risks of replacing the product and make the swap if the risk is low enough. HeartWare claims that new versions of its product do not expose the patient to the same risk due to improvements.

Unfortunately, defective medical devices have injured many people in West Virginia, creating excessive medical bills and lost wages. Those who have been injured in such a manner have the option of turning to a civil court for legal recourse. A successfully presented case could result in an award of damages that could help with the various financial ramifications and other damages stemming from such a product. An experienced products liability attorney can examine a person's case and provide advice regarding his or her legal options.
