Defective medical devices may cause or speed up cancer growth

Dangerous or defective products cause thousands of injuries each year to individuals throughout the United States, including right here in West Virginia. These dangerous products include defective medical devices that are designed, manufactured and sold in order to help consumers. Unfortunately, when these devices do not meet certain safety and use regulations, it can result in unnecessary injuries for anyone who used or is using the device.

A woman is accusing two pharmaceutical companies for designing and selling a morcellation device that she believes caused her cancer. The woman had undergone a hysterectomy in April 2014. At the time of the surgery, she has a uterine mass removed using a uterine morcellation. Reportedly, there was no reason to believe at that time that the woman had any type of metastatic disease or cancer.

However, a short while later, the woman was diagnosed with uterine cancer. She eventually became aware of evidence that led her to believe that the reason for the cancer development was from the morcellator medical device that was used during her surgery. As a result, the woman says that she suffered permanent damages that include, but are not limited to, loss of earnings, loss of enjoyment of life, medical expenses and increased risk of death.

One problem with West Virginia product liability cases, even with defective medical devices, is that they are somewhat complex. They can often be very confusing for individuals who are not experienced with the law and what a case like this entails. However, with the proper assistance and preservation of evidence, it may be possible to hold the appropriate party responsible for the harm caused.
