Dunkin' Donuts loses suit alleging dangerous property conditions

A routine trip to a restaurant in West Virginia can end up changing a person's life for the worse if the individual ends up getting injured there. One woman in another state said dangerous property conditions at a Dunkin' Donuts caused her to suffer serious injuries. She filed a suit against the chain restaurant and recently won more than $500,000 in the suit.

The woman said she was at a Dunkin' Donuts one day and was carrying four cups of hot coffee. As she was walking to her car, she reportedly tripped over a spike that was coming from a curb beside her vehicle. She said one of the parking lot's concrete slabs was broken, which left the spike exposed.

The woman reported that she landed on her right side as a result of the trip-and-fall accident. The coffee spilled all over her as well, leaving her with serious burns on the arms, face and neck. Since the accident, she has had to undergo surgery on her lower back and rotator cuff. She also suffers numbness on the right side of her body and can no longer perform the nursing home job she used to enjoy. The woman thus filed a suit, claiming negligence on the part of the doughnut shop.

The woman was awarded $522,000 for her injuries, although she said no quantity of money could eradicate her pain. When a company's dangerous property conditions in West Virginia causes a patron to suffer injuries, the victim has the right to sue the company, seeking damages. A monetary award may not only help to cover medical costs tied to the injury incident, but it may also help to address emotional distress caused by the ordeal.
