West Virginia shoppers naturally trust the products they purchase to be both effective and safe. Unfortunately, some of these items are defective products, which pose hazards that can cause injury or even lead to death. One particular product that is currently being recalled is a water bottle by Zak Designs.
This water bottle is 20 inches tall and holds 26 ounces. It comes in various colors and features characters such as Spiderman, Captain America and Minions. Each bottle features a twist-off cap as well as a flip-top spout and an inner plastic straw in the spout area. However, the straw has the potential to break, thus posing a choking hazard.
About 178,000 of these water bottles were sold at Target stores. So far, Zak Designs has gotten nine reports regarding straws breaking, including seven reports about children spitting out plastic fragments while using the product. There have been no reported injuries. Customers are encouraged to stop using the products and to contact the manufacturer for directions on how to get a free cap and straw to replace the defective one.
Consumers in West Virginia who are hurt after using defective products have the right to seek to hold the product manufacturers accountable through a product liability lawsuit. After all, manufacturers are expected to thoroughly and carefully design and test their products before they put them on store shelves. In a successful case, a court may award damages to pay the customer back for the harm caused by the use of the defective product.
