When a vehicle in West Virginia malfunctions due to a defect, the lives of the vehicle’s driver, the passengers and other motorists on the road are at risk. If a death happens due to auto defects, the car maker may be held accountable in civil court. One company, Mazda, has recently issued a recall that affects hundreds of thousands of vehicles.

Mazda decided to expand a recall of air bags on its vehicles’ passenger sides. The recall stems from the fact that the air bags can inflate with an excessive amount of force, thus rupturing the metal inflator and spewing fragments made of metal into the automobile. This new recall covers more than 374,000 automobiles.

The cars included in the recall include the Mazda6 from the years 2003 to 2008, the Mazdaspeed6 from the years 2006 to 2007 and a small number of the RX-8 sports car from the model year of 2004. Mazda is among a dozen carmakers recalling airbags produced by Takata Corp. Nine deaths throughout the world are said to have been caused by this problem. Some of the car company’s affected vehicles were recalled starting in 2013; however, the company said it recently decided to expand the recalls after receiving new data from Takata in December 2015. Mazda is also recalling air bags on the driver’s side under different recalls.

Auto defects at times are not addressed early enough, so they end up causing major injuries or death before an auto recall is issued. People who are injured as a result of malfunctioning vehicles in West Virginia have the right to file personal injury claims against the manufacturer. Likewise, the surviving family members of a person who dies due to an auto defect may choose to file a wrongful death claim, seeking the reimbursement of financial damages sustained as a result of the use of the dangerous vehicle.
