Infections may result from medical malpractice

When a doctor in West Virginia does not properly treat a patient and the patient suffers physically as a result, he or she has the right to try to hold that doctor accountable. In some cases, medical malpractice may lead to serious infections that can disrupt one's quality of life. In one out-of-state case, a woman claimed that her dentist improperly treated her and thus caused her to suffer a brain infection. She has filed a medical malpractice lawsuit against the dentist as a result.

The woman in her complaint alleged that she was experiencing gum pain and, therefore, went to the dentist's office. The dentist reportedly told her that an abscess was present in her mouth. This abscess ended up developing into an intracerebral abscess.

The woman asserted that the dentist was responsible for her intracerebral abscess because she did not provide appropriate treatment for the abscess, such as an antibiotic. This alleged failure on the dentist's part caused the patient's condition to worsen. As part of her lawsuit, the woman is seeking a jury trial along with damages and any other relief that the court determines to be fit.

In West Virginia, competent proof of negligence is necessary to establish liability in medical malpractice cases involving infections. Compensatory damages may be awarded in a case that is litigated successfully, and punitive damages may also be awarded in a case of egregious fault. Although a monetary award cannot undo the events that caused a person to suffer injury at the hands of a doctor, it may help the patient to experience a sense of justice in the ordeal.
