West Virginia Spinal Cord Injury Lawyer

Spinal cord injuries, also known as SCIs, can be catastrophic and lead to lifelong impairment. In many cases, SCI victims are even left fully or partially paralyzed. Major bodily functions such as breathing, and muscle movement rely on the nerve signals within the spinal column. This means that spinal cord injuries (SCI) can be extremely debilitating. Victims often require extensive medical intervention and face long-term disability, both of which can impact their ability to work. In many cases, SCIs can even result in full or partial paralysis.

If you or a loved one has suffered an SCI at little to no fault of your own, you may be entitled to significant legal compensation. The personal injury lawyers at Warner Law Offices, PLLC, are here to make sure you understand your full legal rights and options. Contact us today to schedule your free, no-obligation consultation with one of our spinal cord injury attorneys. We proudly serve West Virginia and the surrounding areas.

Do I Need a Spinal Cord Injury Attorney to Handle My Case?

Because spinal cord injuries can be catastrophic, SCIs often involve high monetary stakes. Types of Spinal Cord Injuries

SCIs can be categorized as incomplete or complete. In an incomplete SCI, nerve signals can still travel to the brain past the point of injury, though an injured person may still experience substantial impairment in their day-to-day life. By contrast, complete SCIs occur when the damage is so severe that there is no signal to the brain from below the point of injury. In other words, the victim is left paralyzed below the injury.

Spinal cord injuries can also be categorized by where they occur along the spine. Lumbar injuries occur in the lower back, thoracic injuries occur in the mid-back, and cervical injuries occur in the neck. SCIs may also impact the sacrum and coccyx, bones making up the lower extremity of the spine.

The severity of an SCI is normally a function of its location and whether it is complete or incomplete. For example, an incomplete lumbar SCI may result in numbness in the legs. By contrast, a complete cervical SCI can result in full paralysis of all four limbs, also known as quadriplegia.

What Type of Compensation Can I Receive for My Spinal Cord Injuries in West Virginia?

If you are injured at little to no fault of your own, you can file a lawsuit seeking compensation from the at-fault party. If the victim is killed due to their injuries, their surviving loved ones can also seek justice, accountability, and compensation through a wrongful death lawsuit. This section explores the compensation available in both scenarios.

Personal Injury Compensation

The amount of compensation you can receive through a personal injury lawsuit, including those involving SCIs, will be driven primarily by the extent and severity of your injuries. Through an SCI personal injury lawsuit, you may be compensated for things like:

  • Past and future medical expenses, including hospitalizations, surgical procedures, lab tests, medical imaging, physical therapy, and medication;
  • The cost of mobility devices, such as wheelchairs and crutches;
  • The cost of accessibility modifications to your home and vehicle, such as ramps and stairlifts;
  • The cost of long-term care services, such as in-home or nursing home care;
  • Lost wages and lowered earning capacity if your injury impacts your ability to work;
  • Physical pain and suffering;
  • Mental anguish; and
  • Lowered quality of life.

Wrongful Death Compensation

The recoverable damages in a wrongful death claim may include some of the damages associated with a personal injury claim. For example, if the victim received medical treatment prior to their death, loved ones can recover the costs. Wrongful death damages may also compensate for things like:

  • Funeral and burial expenses;
  • Lost wages, benefits, and other earnings the deceased victim would have contributed to their family if their injury had not occurred;
  • Loss of companionship, care, and protection from the deceased; and
  • Sorrow and mental anguish.

Punitive Damages

In some cases, SCI victims may also be entitled to punitive damages. In West Virginia, these damages are reserved for cases in which the at-fault party acted “with actual malice toward the plaintiff or a conscious, reckless and outrageous indifference to the health, safety and welfare of others.” This form of damage is meant to punish the party responsible and deter future misbehavior. Though rarely awarded, punitive damages can significantly raise the value of your claim when available.

Causes of Neck & Back Injuries

Many types of accidents can cause painful back and neck injuries. Common causes of neck and back injuries include the following:

If another person’s negligence or reckless actions caused your injuries, Warner Law Offices can help you take legal action. You deserve compensation for your medical bills, lost wages, and other damages, putting financial and emotional stress on you and your family. Who Is Liable for a Spinal Cord Injury?

To recover compensation through an SCI claim, plaintiffs must prove that another person or entity is liable. In some cases, multiple parties may be liable for the same injury.

Of course, the evidence needed to prove liability will depend on the facts of the case. Ultimately, each case is unique and requires individualized attention from a skilled attorney. To illustrate the wide range of possibilities, liable parties may include a:

  • Driver in an auto accident case,
  • Property owner in a slip-and-fall case,
  • Trucking company in a truck accident case,
  • Third-party contractor in a construction accident case,
  • Negligent surgeon in a medical malpractice case, or
  • Government entity responsible for road maintenance in a motorcycle accident case.

No matter the circumstances, Warner Law Offices, PLLC, is ready to carefully evaluate your case and pursue all sources of liability. We will conduct a thorough, independent investigation and leave no stone unturned.
