Alleged delayed diagnosis leads to man's death

The apparent delay of a medical diagnosis at a medical center resulted in the death of a man in another state. The man's daughter has therefore filed a malpractice claim against the medical center. If a delayed diagnosis occurs in West Virginia, the medical center responsible for it could face claims for financial responsibility through the civil court system.

According to the lawsuit, the man was experiencing symptoms associated with severe infection along with impending sepsis. He went to the hospital for treatment, but a doctor allegedly misdiagnosed him. The man then sought medical care at an emergency medical provider. The daughter claims that her father was denied care initially and then was admitted after eight hours but still did not receive a correct diagnosis until after he had developed sepsis.

The daughter asserts that an internal medicine physician should have properly diagnosed the man's condition.  She claims that the delay of his diagnosis and treatment resulted in his death. The daughter is suing for damages related to the suffering of her father along with her mental anguish stemming from the ordeal.

A delayed diagnosis and therefore a delayed treatment in West Virginia breaches the standard of care that exists in the medical field. If a doctor has failed to meet this standard of care and a patient passes away, he or she may face a malpractice claim filed by the deceased patient's surviving family members. A monetary award in a successfully litigated claim may help to cover burial costs, medical bills and other related monetary losses.
