Alleged Improper Use of Restraints Leads to Lawsuit

A mother-and-daughter pair in another state recently claimed that staff at a nursing home inappropriately confined the mother one night. They have, therefore, decided to sue the nursing home. If a nursing facility in West Virginia has allowed the improper use of restraints on a resident to take place, it may be held liable through the civil court system.

According to the lawsuit, two nurses at the nursing facility left the mother confined overnight. They are said to have done this by tying the woman, age 84, to a wheelchair using bed sheets. They then allegedly injected a narcotic sedative into the woman in an effort to keep her quiet.

According to the plaintiffs, the administrators at the facility failed to notify the daughter about the incident. In fact, the facility reportedly terminated any nursing staff who reported the incident and performed an internal investigation to prevent negative publicity. The women further claimed that nursing staff tied down yet another woman at the same time that the mother was being confined. The nursing facility, however, has denied the women’s allegations.

In their lawsuit, the women are pursuing damages totaling $17 million against the nursing home’s management company, the nursing facility itself, the two nurses allegedly involved, the nursing director and the facility’s administrator. If an individual in West Virginia or elsewhere is a victim of the improper use of restraints at a nursing facility, it is within his or her right to file a legal claim, seeking damages. A monetary award cannot undo the events for the victim, but it may help the victim to feel a sense of justice following this type of ordeal.
