Car accident leads to death, injury in West Virginia

An individual's life was sadly cut short in a tragic motor vehicle crash in West Virginia. The two-car accident took place on a recent Sunday evening. Now, the victim's surviving family members are left to grapple with how and why the car accident occurred.

The car accident took place at about 6:20 p.m. along West Virginia 61 at an intersection. According to authorities, the drivers of both of the cars involved in the accident suffered injuries in the collision. One of them had to be extricated by fire officials prior to being taken to the hospital.

The man who was extricated from his motor vehicle is reportedly now in stable condition. However, the other motorist was pronounced deceased at the crash scene. This driver was under the age of 18. Authorities continued to investigate the cause of the fatal accident.

If police reveal that the injured man caused the accident due to negligent driving -- for instance, speeding -- then the surviving loved ones of the individual who died in the crash may decide to file a wrongful death claim against him, seeking the reimbursement of monetary damages sustained. Likewise, if the individual who died is discovered to have caused the accident, the injured party may decide to file a personal injury claim against this person's estate and anybody else with an ownership interest in the car that he or she was driving. Liability must be established, based upon a showing of negligence, before claims for damages will be determined. A case that is litigated successfully might result in damages that may help the plaintiff to cover burial costs, hospital bills or other losses stemming from the unfortunate West Virginia car accident.
