HUNTINGTON – A certified nursing assistant is suing a Cabell County hospital, alleging discrimination, retaliation and wrongful termination.
A complaint was filed in the Cabell Circuit Court against Mildred Mitchell-Bateman Hospital, alleging violation of the West Virginia Human Rights Act.
The plantiff, who is a black male, was unlawfully terminated from his employment at the hospital earlier this year due to his race. The suit says he has suffered and will continue to suffer lost wages and benefits, emotional distress, embarrassment and inconvenience.
The plaintiff alleges Mildred Mitchell-Bateman Hospital subjected him to a hostile work environment, disparate treatment and termination based upon his race.
Bobby Warner and Kamron Miller seek a trial by jury, compensatory and punitive damages, interest, costs, attorney fees and all other just and equitable relief for the plantiff.
