Personal Banker Alleges She Was Discharged Due to Age

LOGAN – A 70-year-old woman is suing JP Morgan Chase, alleging age discrimination and wrongful termination.

Delores Clay filed a complaint in Logan Circuit Court against JP Morgan Chase Bank NA, Julius Nichols and Randy Morgan, alleging violation of the West Virginia Human Rights Act.

According to the complaint, on Nov. 17, 2017, after being employed as personal banker at Morgan Chase for 12 years, Clay was terminated from employment. The suit says Clay was replaced by a substantially younger employee.

Furthermore, the lawsuit states, throughout Clay’s employment she was subjected to harassment and pretextual discipline inconsistent with the discipline taken against younger employees. Despite numerous demotions, the suit says, Clay continued to perform well and was ranked as a top personal banker several times in the months leading up to her constructive discharge.

The plaintiff alleges JP Morgan Chase Bank, Nichols and Morgan subjected her to disparate treatment and adverse employment actions, in whole or in part, because of her age.

Clay seeks trial by jury, full compensation, with pre- and post-judgment interest, attorney fees, court costs, punitive damages, plus all further just relief. She is represented by attorney Robert B. Warner of Warner Law Offices PLLC in Charleston.
