A Kanawha County couple is suing tractor trailer operators, citing alleged negligence.

The plaintiffs filed a complaint in Mason Circuit Court against Putnam Transport LLC and the driver of the tractor trailer, alleging that Putnam Transport negligently maintained its tractor trailer and allowed it to be operated on the public roadways in West Virginia.

According to the complaint, the plaintiffs allege that on Oct. 10, 2018, the first plaintiff was involved in an auto collision with the defendants’ tractor trailer at or near the intersection of US Route 35 and State Route 42. He sustained serious injuries and incurred medical expenses, lost wages and other damages. The second palintiff has been deprived of her husband’s society and services.

The plaintiffs holds Putnam Transport LLC and the driver responsible because the driver negligently took his eyes off the roadway and operated his phone while driving.

The plaintiffs request a trial by jury and seek judgment against defendants, jointly and severally, for all damages, with interest, costs and all other relief as allowed by law. They are represented by Truman C. Griffith of Warner Law Offices PLLC in Charleston.
