West Virginia car accident claims 1 life, causes 1 injury

A woman's life has been cut short as a result of a tragic motor vehicle wreck in West Virginia. Now, her surviving family members are left to grieve and question how the accident could have happened. A man was also injured in the car accident.

The car crash took place on a recent Monday at 4 p.m. along United States Route 119. Police said the crash was a T-bone type of collision. The woman who passed away in the collision was 27 years old.

The woman was a first-grade teacher at a local school. She had just departed from a day of training at the area high school when the crash occurred. The man who was injured in the accident was transported to the hospital with injuries deemed not to be life-threatening.

If police learn that the man caused the accident due to negligent driving -- such as speeding -- the family members of the deceased woman may decide to file a wrongful death claim against him, seeking the reimbursement of monetary damages. Meanwhile, if the woman is found to have negligently caused the accident, the man may opt to file a personal injury claim against her estate and also against any person with an ownership in the car she was operating at the time of the accident. Either way, liability must be established before damage claims will be decided in civil court. A successfully fought claim might lead to a damage award that may help with addressing hospital expenses, funeral costs and other losses associated with the West Virginia car accident.
