Family Files Suit Against Nursing Home, Alleging Physical Abuse

The loved ones of a man in another state recently claimed that a nursing home abused him. They have thus filed a lawsuit against the nursing facility, alleging physical abuse. Likewise, anyone in West Virginia who believes that his or her loved one is being mistreated at a nursing facility has the right to take legal action.

In the recent out-of-state case, the elderly man who was reportedly abused had sought care at the nursing facility following a bowel obstruction surgical procedure. The 89-year-old man’s son became concerned after allegedly seeing his father with several cuts and bruises. The elderly man had also reportedly lost a significant amount of weight.

The attorney of the family claimed that the nursing facility blamed the injuries on the man’s falling 11 times during a period of five months. However, the son concealed a camera inside an alarm clock near the bed of his father. He reportedly gathered over 100 clips revealing neglectful behavior during a two-day period. The elderly man’s family ended up taking the man out of the home.

Nursing facilities in West Virginia and elsewhere are naturally expected to exercise reasonable care when tending to their residents, especially because their residents are often the most vulnerable members of the population. However, not all nursing care facilities live up to these standards. If a nursing home resident suffers physical abuse at the hands of the staff, the resident’s loved ones may choose to file a liability claim against the facility, seeking damages. A monetary award in a successfully fought lawsuit cannot undo the events leading to the resident’s injuries, but it may help the victim and his or her family members to experience a sense of justice in light of the incident.
