Woman Died in Nursing Home Due to Alleged Physical Abuse, Neglect

 | Mar 28, 2018 | Nursing Home Abuse & Neglect

A man in another state says that his mother passed away due to the neglect she suffered in a nursing home. The woman also reportedly suffered physical abuse in the nursing facility, and the man has decided to sue. Likewise, individuals in West Virginia who have lost their loved ones due to the carelessness of nursing home staff have the right to seek full financial accountability through the civil court system.

The man says that his mother, 84, was immobile and thus was confined to a wheelchair as a result of arthritis. He claims that his mother’s urinary tract became infected while she was at the nursing home. The infection apparently ended up spreading to her kidneys and proved fatal in just a few days.

It is alleged that the urinary tract infection occurred because staff left her in feces and urine each day, sometimes for hours. In fact, he asserts that this is a known issue at the nursing home. He claims that he had raised complaints about the facility’s conditions to the facility and the state. In fact, the state recently accused the facility of committing multiple violations, including patient neglect and understaffing.

Nursing homes are expected to treat their residents with care. After all, their residents are generally among the most vulnerable members of the population. Unfortunately, this does not always happen. When nursing facility residents pass away due to physical abuse by staff, surviving loved ones may choose to file liability claims against the staff and the nursing home itself, seeking a judgment for monetary damages incurred. An understanding of what facts need to be proved will likely be critical to prevail in such a case in West Virginia.
